Terms of Service

1. Who These Terms Are With

QuickStudy is developed and provided by Jaiden Henley ("the developer," "we," or "us"). These terms are an agreement between you and the developer, not Apple. They sit alongside Apple'sLicensed Application End User License Agreement(the "Apple EULA"), which also applies to your use of the app. Where these terms and the Apple EULA conflict, the Apple EULA governs your relationship with Apple.

2. Eligibility

You must be at least 13 years old to use QuickStudy. If you're under the age of majority where you live, your parent or guardian must agree to these terms on your behalf, including for any purchase.

3. License

The developer grants you a personal, non-exclusive, non-transferable, revocable license to use QuickStudy on Apple devices you own or control, as allowed by the Apple EULA and App Store rules. You may not copy, modify, reverse engineer, or redistribute the app, except where the law allows it despite this restriction.

4. Your Content

You keep all rights to the documents, notes, and text you bring into QuickStudy, and to the cards made from them. The developer claims no ownership of your content. When you use cloud generation, you give the developer and its service providers a limited permission to process your content only to generate your cards, as described in thePrivacy Policy.

You're responsible for having the right to use any content you import. Don't upload material you don't have permission to use, or material that is illegal.

5. AI-Generated Cards

QuickStudy uses AI to draft flashcards, answer choices, and explanations. AI can make mistakes: cards may be inaccurate, incomplete, or misleading. That's why every card arrives as a draft, with its source, for you to review before saving. Check important material against your original notes. QuickStudy is a study aid. It doesn't replace your coursework, instructors, or professional advice, and the developer doesn't guarantee any academic result.

6. Free Generations

QuickStudy includes a limited number of free card generations. Currently that's one free cloud generation per device (if you allow it) and 10 free on-device generations each calendar month. Free generations have no cash value, don't carry over, and may be changed. Don't try to get around these limits, for example by changing your device's clock or tampering with the app.

7. QuickStudy Pro Subscription

• What you get. QuickStudy Pro is an auto-renewing subscription that generates cards on QuickStudy's server. It currently includes up to 150 cloud generations per month. Unused generations don't carry over. Individual requests are subject to size and rate limits.
• Billing. Pro is offered monthly and yearly. The current price is shown in the app before you buy. Payment is charged to your Apple Account when you confirm the purchase.
• Automatic renewal. Your subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple Account is charged for renewal within the 24 hours before the period ends.
• Free trials. If you're offered a free trial, it converts to a paid subscription when it ends unless you cancel at least 24 hours before then. Any unused part of a trial is forfeited when you buy a subscription.
• Managing and canceling. Manage or cancel anytime in Settings › Apple Account › Subscriptions, or from Settings › Manage Subscription inside QuickStudy. When you cancel, Pro stays active until the end of the period you've already paid for.
• Refunds. Apple processes all payments and refunds, under Apple's policies. The developer can't issue refunds directly. You can request one atreportaproblem.apple.com.
• Changes. The developer may change Pro's price or features. Apple will notify you of a price change as its rules require, and you can cancel before it takes effect.

8. Acceptable Use

You agree not to:

• use QuickStudy for anything illegal, or to create or spread content that is illegal, infringing, or harmful;
• access, probe, or overload QuickStudy's server other than through the app, or try to get around its security, App Attest checks, subscription checks, or usage limits;
• resell, share, or automate access to cloud generation; or
• use cards or other output from QuickStudy to build a competing AI model or service.

The developer may suspend cloud generation for a device or subscription that breaks these rules.

9. Third-Party Services

If you add your own API key, your requests go straight to that provider under its own terms and pricing. You're responsible for that relationship and any charges. Cloud generation relies on Cloudflare, and purchases rely on Apple. The developer isn't responsible for third-party services it doesn't control.

10. Availability and Changes

The developer works to keep QuickStudy running well, but features, including cloud generation, may sometimes be unavailable, change, or be discontinued. On-device features keep working without QuickStudy's server. If cloud generation is permanently discontinued while you're subscribed, the developer will stop offering Pro, and you can ask Apple for a refund of any unused period.

11. Disclaimer

To the fullest extent the law allows, QuickStudy is provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions don't allow these exclusions, so some of them may not apply to you.

12. Limitation of Liability

To the fullest extent the law allows, the developer isn't liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or academic outcomes, arising from your use of QuickStudy. The developer's total liability for any claim relating to QuickStudy is limited to the greater of the amount you paid for QuickStudy Pro in the 12 months before the claim or US $50. Nothing in these terms limits liability that the law doesn't allow to be limited.

13. Termination

You can stop using QuickStudy anytime by deleting it and canceling any subscription. The developer may end or suspend your access if you seriously or repeatedly break these terms. Sections 4, 5, and 11–15 remain in effect after termination.

14. Governing Law

These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be heard in the state or federal courts located inMichigan, and you and the developer agree to their jurisdiction. If you're a consumer, this doesn't take away any protections you have under the mandatory laws of the country where you live, or your right to bring a claim there.

Before filing any claim, please email jaidenhenleydev@gmail.com and give the developer 30 days to try to resolve it.

15. General

If any part of these terms can't be enforced, the rest still applies. If the developer doesn't enforce a right right away, that doesn't give up the right. You can't transfer these terms to anyone else. The developer may transfer them if QuickStudy changes ownership. These terms, the Privacy Policy, and the Apple EULA are the entire agreement about QuickStudy.

16. Changes to These Terms

If these terms change, the new version will be posted here with a new "Last updated" date. Significant changes will also be announced in the app or in its App Store release notes. Continuing to use QuickStudy after a change means you accept the updated terms.
